Every location in the district is required to post the Labor Laws Poster. FMLA is a serious issue! Either something is or is not FMLA. There is no decision as to whether the employee wants it or the employer wants to give it if it truly qualifies as FMLA. Some people qualify, some do not. Some circumstances qualify, some do not. Call Personnel/Insurance to evaluate each circumstance.

FMLA is based on law - it does not go to the Board for a decision. However, if FMLA is exhausted or if the employee does not qualify for FMLA, the employee may be eligible for Board Approved Medical Leave. Please read the posted notice, but call me to evaluate the person and circumstance. Our office issues the FMLA paperwork. If the employee tells any of the clerical or administrative staff that they have one of the circumstances listed below, the EMPLOYER has been notified of their need and is responsible for issuing FMLA notice.The employee DOES NOT need to say "FMLA" or "medical leave", but when they tell you one of the following things, the employer has been notified of that employee's need. Please follow through and notify us!

The Jackson County School District uses the Calendar Year measure.


A covered employer must grant an eligible employee up to a total of 12 weeks of unpaid leave during a 12 month period for one or more of the following reasons:

The birth and care of the newborn child of the employee
For placement with the employee of a son or daughter for adoption or foster care
To take care of an immediate family member (spouse, child, or parent) with a serious health condition
To take medical leave when the employee is unable to work because of their own serious health condition


To be eligible for FMLA benefits, an employee must:
Have worked for the employer for a total of at lease 12 months and
Have worked at least 1,250 hours over the previous 12 months.
