The Jackson County Board of Education met in Regular Session on Monday, April 19, 2004, at 5:00 p.m. at the Board of Education Building, 12210 Colonel Vickrey Road, Vancleave, Mississippi.

The following members were present:

The meeting was called to order at 5:07 p.m. by chairman, Kenneth A. Fountain. Board member Turner gave the invocation, and the Pledge of Allegiance was led by board member Tootle.

ACKNOWLEDGEMENTS AND CELEBRATIONS: The following individuals, teams, or groups were recognized by administrators for recent achievements and accomplishments and were acknowledged by the Board:

THREE MILL NOTE: Motion by Turner, second by Sims, to approve adoption of note resolution of the Board of Education of the Jackson County School District, authorizing and directing the issuance of a four million five hundred thousand dollar principal amount note of the Jackson County School District, awarding the sale of the note to Merchant & Marine Bank, and taking other actions regarding said note, bid tabulation sheet and resolution shown on pages 198-A, with the following vote taken:

EAST CENTRAL CURRICULUM PRESENTATION - EAST CENTRAL HIGH SCHOOL: Brenda Salter, Art Instructor at East Central High School, detailed the importance of art in the education of children and how art benefits children in many facets of their life.

Owenby arrived at 5:25 p.m.

TECH PREP SITE VISIT - ST. MARTIN: Assistant Superintendent Havard recognized St. Martin High School Tech Prep programs for the outstanding evaluation received from the Tech Prep Office of the Mississippi Deparment of Education following a recent site visit. The program was cited for many outstanding accomplishments and, most impressive, there were no suggestions for improvement. St. Martin High School was commended for the effort expended in making tech prep a successful program within their attendance center. Dr. Havard also noted that all three of the Tech Prep programs in the Jackson County School District received outstanding evaluations with no suggestions for improvement.

SUMMER HOURS AND HOLIDAYS FOR TWELVE-MONTH EMPLOYEES: Motion by Turner, second by Owenby, to approve summer hours and holiday schedule for twelve-month employees as presented, shown on page 198-B, with the following vote taken:

TEACHER APPRECIATION WEEK RESOLUTION: Motion by Tootle, second by Owenby, to approve resolution recognizing the teaching staff of the Jackson County School District, May 3 through May 9, 2004, designated as Teacher Appreciation Week, with the following vote taken:

REQUEST FOR MEDICAL LEAVE: Motion by Owenby, second by Sims, to approve request of Regina Hamilton, Food Service at St. Martin Middle School, for medical leave from March 27-April 28, 2004, with the following vote taken:

APPROVE PURCHASE OF EAST CENTRAL PROPERTIES: Motion by Turner, second by Sims, to approve purchase of two properties, one 6.78 acre parcel for $64,410 and one 1.2 acre parcel with home and improvements for $70,590, from Rex Waltman, properties adjacent to East Central Lower Elementary School at Section 32, Township 4 South, Range 5 West, with the following vote taken:

APPROVE ADDITION TO WORK - EAST CENTRAL HIGH SCHOOL: Motion by Sims, second by Turner, to approve addition to the scope of work at East Central High School for an additional $1,010.00 for cutting and removal of the corridor and door openings in the existing school in order to tie in the new addition to the existing building, with the following vote taken:

RETIREMENT RESOLUTION - MYRA POLK: Motion by Sims, seond by Turner. to approve retirement resolution for Myra Polk, kindergarten teacher at St. Martin North Elementary, with the following vote taken:

SIXTEENTH SECTION - R. T. MAY IV - 16-4-7: Motion by Tootle, second by Owenby, to approve amendment to sixteenth section residential lease of R. T. May IV, Section 16, T4S, R7W, to add the following Paragraph 15 to existing lease, with the following vote taken:

In the event of condemnation or other taking for public use under powers of eminent domain of all or part of Lessee’s interest in the leased premises, payments for such condemnation or taking of Lessee’s leasehold interest shall be payable to Lessee, or, if the Lessee’s premises are encumbered by a mortgage or Deed of Trust, payment for the leasehold estate shall be made in accordance with the terms and provisions of such mortgage or Deed of Trust. Leasehold mortgagee (or trustee for restoration in the case of partial awards) shall be entitled to receive payment of a condemnation award to which Lessee is entitled. The payment must not be less than the total award less the value of the land considered as unimproved.

SIXTEENTH SECTION - HAL CRAIG DAVIS - 16-6-7: Motion by Turner, second by Tootle, to approve request of lessee Hal Craig Davis to reduce the size of his commercial lease property by approximately one acre, with the following vote taken:

SIXTEENTH SECTION - HAL CRAIG DAVIS: Motion by Turner, second by Sims, to rescind the previous motion on the request of lessee Hal Craig Davis to reduce the size of his sixteenth section commercial property until further study by the attorney, with the following vote taken:
